Terms and Conditions

The rules for buying our digital products and hiring our services: what your payment includes, what it does not, how payment works, and what happens with changes.

A. General Terms

Elevalia is the brand under which Marcos Ramírez Mora, an individual with an address in Zapopan, Jalisco, Mexico, offers digital products and services for businesses: websites, systems, custom software, AI chatbots, NFC solutions, digital loyalty cards, search positioning, campaigns, product photography, digital invitations, and trademark registration.

By buying a product, accepting a proposal, or paying for a service, you confirm that you have read and accept these terms and that you are an adult with the legal capacity to enter into a contract. Published prices are for reference; the price that applies is the one in your proposal or the one shown at checkout.

B. Digital Products

These are self-service products with a one-time payment, priced in Mexican pesos:

  • AI Suite: Gratis.
  • Unfollow Detective: $129 MXN.
  • MiniLab: $299 MXN.
  • DeskFlow: $499 MXN.
  • Social Master Kit: $699 MXN.
  • Bundle Kit: $1,199 MXN.

Access. To use a digital product you create an account with your email address and a password, or sign in with Google, and you confirm your email address with a 6-digit verification code sent by email. You sign in from My account, which keeps your session with a cookie of our own. The DeskFlow PIN has been retired and is no longer used. You are responsible for using an email address you control and for not sharing your password or your codes.

License. You receive a personal, non-exclusive, non-transferable license to use the product for yourself or your business. You may not resell, redistribute, share your access, or copy the content to offer it as your own. If we detect shared access, we may suspend it without a refund.

7-day guarantee. Paid products carry a 7-calendar-day satisfaction guarantee from the date of purchase: if you are not happy with it, request a full refund, no explanation needed, using the “Request a refund” link in your receipt. The refund is made through Mercado Pago to the same payment method you used and may take a few business days to show up, depending on your bank. When a refund is issued, your access to the product is removed. If you do not have your receipt, you can ask for it by writing to contacto@elevalia.com.mx within the same 7-calendar-day period, and we will refund you the same way.

Exception: Unfollow Detective has no satisfaction guarantee, because its results depend on the Instagram account and on changes to that platform that are outside our control. AI Suite is free, so refunds do not apply.

AI Suite and the newsletter. To open the AI Suite vault, you subscribe to the Elevalia weekly newsletter and state that you are an adult. You can unsubscribe at any time using the link in any email, and the vault remains available with your email address even if you unsubscribe. For the products you bought and in My account, the newsletter is optional: we only subscribe you if you check the box, and your access does not depend on it.

C. Services

"Starting at" prices. The price shown for each service is the minimum it starts at, not a fixed package. The service pages describe everything a service can include; each element you add (more pages, more features, more pieces, integrations, locations, or volume) can raise the final price. For example, digital loyalty cards start at their published price, and if you want them to include everything described on their page, the price goes up. The final price and what it includes are written in your proposal before you pay.

1. Scope: only what is in writing. Before we start, you receive a written proposal listing what the service includes: pages, features, pieces, deliverables, and timeline. Anything that does not appear in the proposal is not included, even if we discussed it, even if it seems small, and even if another provider includes it. If you need something more, we quote it separately before doing it, and it is only done if you approve it.

2. Payments. The service is paid 50% at the start and 50% on delivery. If you choose to pay in interest-free installments, the charge is for 100% at the start, in a single Mercado Pago link, and the client chooses the number of months with their bank. Work begins when the initial payment is received. The final website, system, or files are published or delivered once the service is paid in full.

3. Revision rounds. Each service includes 2 rounds of revisions on what we deliver. A round is a single list of adjustments sent all at once, not loose messages spread over several days. Changes within scope are made at no cost until the rounds are used up; after that, or if a change goes beyond the scope (a new section, a new feature, a redesign, changing something you already approved), it is quoted separately.

4. Our part and your part. We deliver the scope and meet the timeline in the proposal. You provide the information, copy, photos, access, and approvals the project needs. The timeline starts once we have everything; if something is missing, the project is paused and the timeline shifts.

5. What the price does not include. Unless the proposal says otherwise: domain, hosting, licenses and monthly fees for third-party platforms (for example, Wallet pass platforms, WhatsApp Business, or AI tools), paid advertising budget, additional physical pieces, IMPI (Mexican Institute of Industrial Property) fees, and maintenance after delivery.

6. Cancellation and refunds. The initial payment reserves your spot on our calendar and covers the work that starts right away, so it is non-refundable once the project has started. If you cancel before we start, we refund what you paid minus payment processing fees. The 7-day guarantee applies only to digital products, not to services.

7. Ownership of the work. Once the service is paid in full, the deliverable made for you is yours: designs, copy, and project files. We retain ownership of our tools, templates, components, and working methods, which we may keep using on other projects, and we grant you a license to use them within your deliverable. We may show the work in our portfolio unless you ask us in writing not to.

8. Results. We work to good professional standards, but we do not guarantee results that depend on third parties: rankings on Google or in AI search engines, sales, reviews, approvals from Meta or the IMPI, or the behavior of external platforms.

D. Liability, Changes, and Jurisdiction

To the extent permitted by law, our liability is limited to the amount paid for the product or service in question, and we are not liable for indirect damages, lost revenue, or failures of third-party services.

We may update these terms and our prices. An accepted purchase or proposal is governed by the terms in effect on that date. The handling of your data is covered in the Privacy Notice.

These terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the courts of Zapopan, Jalisco.
