1. Data Controller

The data controller responsible for your personal data is Marcos Ramírez Mora, an individual who operates the Elevalia brand, with an address in Zapopan, Jalisco, Mexico. For anything related to this notice, write to contacto@elevalia.com.mx.

This notice is issued under the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and applies to elevalia.com.mx, our digital products, and the services you hire from us.

2. Data We Collect and How

  • When you message us on WhatsApp or by email: your name, phone number, email address, and whatever you tell us about your business or project.
  • When you book a call on Google Calendar: your name, email address, and the information you enter when booking.
  • When you sign up for or buy a digital product: your name, email address, phone number, and the product you purchased.
  • When you create an account: your email address, your password (stored only encrypted, never in readable text), and your language. If you sign in with Google, we receive your email address and name from Google and link them to your account; we do not store your Google photo. The 6-digit verification code we email you expires and can be used only once. When you sign in we keep a session in an Elevalia cookie of our own, which is needed to keep you signed in.
  • When you use our online tools (DeskFlow, the Social Master Kit calendar, MiniLab): what you load into them, such as tasks, posts, or your progress, tied to your account.
  • When you hire a service: contact details, billing details if you request an invoice (RFC tax ID, legal name, tax address), and the information and materials about your business that you give us to do the work.
  • When you browse the site: technical and usage data (pages visited, device, approximate city) through cookies, only if you accept them. The details are in the Cookie Policy.

Payments: charges are made through Mercado Pago using a payment link. Mercado Pago receives and protects your card details; we never see or store them.

We do not collect sensitive personal data (such as health, religion, ethnic origin, or preferences). Please do not send it to us through any channel.

3. How We Use Your Data

Necessary purposes, without which we cannot serve you:

  • Responding to your requests, preparing quotes, and following up with you.
  • Setting up your account and giving you access to the digital products you buy.
  • Performing the services you hire, delivering the work, and providing support.
  • Generating charges, payment links, and invoices, and keeping track of payments for your project.
  • Notifying you of changes to your purchase, your service, or these documents.

Additional purposes, which you can decline without affecting your purchase or service:

  • Sending you news, promotions, and content from Elevalia.
  • Elevalia weekly newsletter. If you subscribe from AI Suite, or check the optional box when you pay for a product, we email you once a week, usually on Tuesdays, with artificial intelligence news, a resource of the week, and our digital products. For this we store your name, your email address, and the date, IP address, and source of the moment you agreed to receive it. You can unsubscribe at any time using the link in every email or by writing to contacto@elevalia.com.mx; unsubscribing does not remove your access to the AI Suite vault or to the products you bought. When we assign you a product we also email you a purchase receipt; that message is about your purchase, not the newsletter, and it has no unsubscribe link.
  • Measuring, in statistical form, how the site is used so we can improve it.
  • Showing the work we did for your business in our portfolio (never your personal data).

To decline an additional purpose, write to contacto@elevalia.com.mx with the subject line "No deseo finalidades adicionales" ("I do not want additional purposes"). You can decline analytics cookies directly in the cookie banner.

4. Who We Share Your Data With

We do not sell or rent your data. We share it only with service providers that help us operate and that process it on our behalf: site and database hosting (Hostinger), payments (Mercado Pago), messaging (WhatsApp), scheduling and email (Google Workspace), and site analytics (Google Analytics and Microsoft Clarity, only with your consent). Some of these providers may process the information outside Mexico.

We may also disclose it to an authority when a law or order requires it.

5. Your Customers' Data in the Systems We Build for You

When we build a website, system, chatbot, loyalty card, or other tool for your business that collects data from your own customers, you are the data controller of that data and are responsible for having your own privacy notice. Elevalia handles it only as a data processor, to build, operate, or support the tool, and does not use it for anything else.

6. How Long We Keep Your Data

For as long as our relationship with you lasts (your access to the product or the ongoing service), and afterward for as long as tax and legal obligations require. Site analytics data is kept for 14 months. When those periods end, we delete the data or anonymize it.

7. Your ARCO Rights and How to Withdraw Consent

You may access your data, rectify it, request its cancellation (deletion), or object to its use (together, your "ARCO" rights), and you may also withdraw the consent you gave us or limit how your data is used. Write to contacto@elevalia.com.mx with:

  • Your full name and the email address or phone number you registered with.
  • An official ID, or your representative's ID along with the document that proves their authority.
  • Which right you want to exercise and over which data.

We will respond within 20 business days and, if your request is approved, carry it out within the following 15 business days. If cancellation would prevent you from continuing to use a product or service, we will tell you before applying it.

8. Security

We protect your data with reasonable technical and administrative measures: encrypted connections, restricted access to the internal admin panel, and passwords stored only encrypted. No system is infallible; if a breach occurs that affects your rights, we will notify you.

Access to the digital products works with your account. For that reason, please do not share your password, your verification code, or your links. The PIN that DeskFlow used has been retired and no longer exists.

9. Changes to This Notice

If this notice changes, we will post it on this page with the new update date and, if the change is significant, we will notify you through the contact method you gave us.
